FG Clarifies Presidential Pardon Process, Says No Inmate Has Been Released Yet

Amid mounting public criticisms over the presidential pardon granted to 175 convicted persons, the Federal Government has clarified that no prisoner has been released, stressing that the exercise is still under review.

In a statement issued on Thursday and signed by the Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), the government explained that the Presidential Prerogative of Mercy is “at the review stage” and not yet final.

“No inmate approved for clemency under the recent exercise of the President’s power of prerogative of mercy has been released from custody,” the statement said.

The clarification follows widespread controversy after a press release published on the State House website, and signed by Presidential spokesman, Bayo Onanuga, listed names of inmates reportedly pardoned by President Bola Tinubu.

Opposition Figures Query Pardon List

The development sparked criticism from opposition figures, including the African Democratic Congress (ADC), former Vice President Atiku Abubakar, former Kaduna State Governor Nasir El-Rufai, and Senator Dino Melaye.

They questioned the inclusion of individuals convicted of drug-related offences and the consideration of Mariam Sanda, who was sentenced for murder.

Exercise Still Under Legal Review

According to the Attorney-General, the process has reached its final administrative stage, which includes a standard review to verify that all names and recommendations comply with established legal and procedural requirements.

“The last stage of the exercise, after approval by the Council of State, is the issuance of the instrument for implementation of the decision concerning each beneficiary,” Fagbemi explained.

“This affords an opportunity for a final review before forwarding the list to the Controller-General of Corrections for necessary action.”

He emphasized that the verification process reflects the government’s commitment to transparency, due diligence, and the rule of law.

Public Engagement Welcomed

The Minister commended Nigerians for their vigilance and feedback, noting that public engagement strengthens institutional integrity.

“There is no delay in the process; it is simply following the law to the letter to ensure that only those duly qualified benefit from the President’s mercy,” he said.
“As soon as all legal and procedural checks are concluded, the public will be duly informed. The rule of law does not rush; it ensures fairness.”

The statement, dated October 16, 2025, reaffirmed the government’s position that due process will be followed to the end before any of the listed inmates are released.
