The office of Abubakar Malami, SAN, has raised alarm over reports that government security agencies may attempt to rearrest the former Attorney General immediately upon his release, despite a court granting him bail.
According to a statement issued by Malami’s media aide, Mohammed Bello Doka, the development “raises grave concerns about due process, the rule of law, and personal safety.”
He recalled that weeks ago, the High Court of the Federal Capital Territory (FCT) granted bail to Malami, but the Economic and Financial Crimes Commission (EFCC) reportedly declined to effect his release, frustrating a valid judicial decision.
Doka said intelligence suggests that operatives of the Department of State Services (DSS) have mounted surveillance at Kuje Correctional Centre and are prepared to act on plans to rearrest Malami on alleged new charges, which are believed to be unrelated to his current case.

“This pattern of granting bail on paper while preparing fresh arrests to ensure continued detention represents a grave assault on constitutional safeguards and an abuse of state power,” the statement read. “It undermines public confidence in the justice system and raises serious questions about respect for judicial authority.”
Malami, Family and Staff Under Threat
The statement warned that the safety of Malami, his family, and his staff is under serious threat. “Any act of intimidation, unlawful detention, or harm arising from these actions must be fully accounted for by those responsible,” it said.
Doka further reiterated that Malami, SAN, has consistently demonstrated respect for the rule of law and compliance with judicial processes, stressing that what is being demanded is nothing more than obedience to court orders and constitutional protections guaranteed to all citizens.
The statement called on relevant authorities, the legal community, civil society organisations, and the international community to monitor the situation closely and ensure that security agencies act strictly within the law.
